house. >> we're just getting started for the, changes. >> it was a nightmare. they offered coverage for myself, my wife, but our daughter was left off. >> it can save you hundreds of dollars in premium costs every month. >> people are signing up, thinking they're going to get some help from the government and find out it's much, much higher than they anticipated. >> this bill is fundamentally flawed. >> what's important to remember is that the law has helped millions of people but there are millions more who stand to be helped. >> the president's health care law continues to wreak havoc on american families, small businesses and the economy. >> you got good ideas? bring them to me. let's go. but we're not repealing it as long as i'm president. >> so does the president's pr offensive have any shot at

working? pat buchanan joins us. the republicans have very different views of this. >> the president made the best case he could. there are people who have medical conditions who have already been helped and their bills have been paid that otherwise would have bankrupted them. that's one case he made. second, he said the republicans simply want to repeal this, they don't have any plan of their own. in a narrow sense, that's an effective little argument. the trouble is, in a macro sense, obama care is a debacle from beginning to end. not only the website, but what's happening at the far end with insurance companies, people losing their policies. so i think he's going to lose this debate for the same reasons he's going to tell the same little stories for three weeks. it's not going to change anything. >> i wonder if he knows anything about cameras and videotape. his opponents have not presented any alternative.

we did a simple google search. one congressman had gun in may, april. there are plenty of alternatives out there, but he says they haven't presented an alternative. that's just not true. >> they've got medical savings accounts and all aspects. >> but how effective can that be when you say that and it's just not so. >> i think what he's saying is there's no agreed-upon republican health care plan to rival obama care. >> so now we have to read into what he said? i tell you what he did say. he says because they sure haven't presented an alternative. that's just false. whether you like the alternative or not, that's false. >> now we've got to go to the third point. where are we headed? he's going to veto any change in

obama care that he doesn't like. i think the republicans could win the u.s. senate in 2014. where are we going to go? a republican senate, a republican house, we would have gridlock for two years, but i don't see how the republicans overturn obama care without a national revolution against it which could get him two-thirds of both houses. >> i do worry about one thing, this website which has been a debacle is a real distraction. i've always thought the website could be fixed. the big problem is number one, can we pay for it. are the young and the healthy really buying into it. we don't know that yet. that's number one. number two is the problem, do we have the doctors to deliver the services. we talk about health care. you're talking about access to health care. there's nothing that i've seen in republicans or democrats have done to enhance our medical delivery. >> i agree with you 100%. we are headed for a disaster.

quite obviously, who is getting into it quickest and who's most persistent in going to that website and getting through and getting help? it's the people with pre-existing conditions who have tremendous medical problems who need a couple hundred thousand dollars paid. who's not going to it? the kid in the ad. >> i think there are far other problems even as far as the mechanics of how this works, the back end. the insurance companies are complaining because they're not going to get paid. what happens when you show up at your doctor in january and you think that you are all enrolled in a program and the doctor calls up the insurance company and they say we have no record of you. >> what happens when the obama care mandates hit all these employers. they hit the individuals at the end of this year, 2013. they start hitting the employers at the end of '14 and all these

companies start dropping their programs and dropping people off of them. what happens then? where do they go? again, as i say, i think we headed for a major collision and a debacle, and i do not for the life of me. i'm reminded of general pa trayous's comment going up to baghdad, will somebody tell me how this ends, because i don't know. >> one of the problems is, the reason why i've isolated this comment because they sure haven't presented an alternative. not only is it flat-out wrong, but he isn't listening. maybe he doesn't like the alternatives. he doesn't even acknowledge the fact that there have been other options. there are a lot of republican whose want to deal with a lot of these problems of pre-existing illnesses and everything, but he flatly denies it even exists and he's selling it to the american people when it's not true. >> let me tell you. the fact that you're responding with some agitation because he's saying something that's not true, this is an effective

argument. it's a political argument. you grab the republicans and say they've got nothing. what are they going to do about portdbility, is there any republican program that they've got up there that's a competitive -- >> it's not effective if people are going to call him out on it. it's not effective. >> would he not rather argue obama care versus the republican program that rather than obama care versus what we see in the papers? >> i don't think on the heels of what happened to him when he made all the promises about if you like your health insurance you can keep it. there's an abc poll recently which says that he's underwater in terms of his honesty and trustworthiness with the american people. if he is now going out and saying things like this, that the republicans haven't presented an alternative, i don't think he's on solid ground. i think he's on the run. >> i think he's on probably better ground than obama care which is underwater and obama is

under water. in 2014, they're going to have to quarantine this guy in the white house, because he will be hemlock to democrats running for the senate. he's already a drag in many of these states. and, again, whereas i say he had some effective aneck dotes here. i don't see how he wins the macro element because there are so many elements going wrong in the whole program. >> he should have said the republican ideas are bad ideas. instead, he said there were never any. he gets caught once again in saying something that's not right. that's just not true. >> what does he do though? when he goes after somebody the republicans say we do have ideas. we got this, that and the other, and if he's in a debate like that, he's in a better debate than he is with the morning papers saying another disaster's occurred. >> so any way, what happens with all this? >> you know, i don't see how

this thing ends. i really don't. i think he's determined. he's going to veto. >> he said he's determined. >> he's going to veto any change to which he does not agree. i did see something in there. he said you know, the republican ideas. it looks to me in this what he said today, mildly sense that he is fishing for some areas where he can bring the republicans over to him. i think where the republican cos run into trouble is if he says show me your reforms. show me your reforms and i'll take a look at them and maybe we can get together on them and they keep saying no. >> pat, that's the exact opposite. what he does is insults the republican leader in the senate. he doesn't name him as mcconnell. if you're trying to get the other side to reach out, to work with you, the last thing you do is first of all say they haven't presented an alternative, which is false. and the next to the last thing you do is insult them. >> he's in full political mode. this is his political offensive. but, again, if there's going to

you may think you signed up for health insurance. but think again. abc political director joins us. so, if you've signed up, do you have health insurance? >> you might. and there's a very good chance that you do. but it's not like going to amazon and ordering something. what happens if you sign up for health care under the obama care website, your information gets transmitted to an insurance company. an insurance company takes your information, starts enrolling new a policy. and everything is smooth, hopefully.

but they may have no record of you or have record of you with the wrong birthday or wrong social security number or wrong number of dependents. all manner of problems. so one little electronic hiccup can mean lots of problems. >> the washington post had an article that said as many as a third impact a third of those who have signed up. >> that under the current numbers could be 40,000 people. we could be talking about continues of thousands of people who have ghost insurance. they think they have it. the white house has known this is a problem for some weeks now. they've had patches involved, a lot of phone calls with the insurance companies. they say the biggest problem involving social security numbers is now taken care of, but this will be a manual process for these insurance companies to make sure the people who think they've enroll rd actually enrolled. that they're getting the billing out. they're actually enrolled in the system and all of this is going to come up against this january

1 deadline. you can sign up as late as the end of december, december 23. so if we're a nation of procrastinators, you could have this big rush of people around seven or eight days around the holidays. >> if there is that error, and i have signed up, and the year passed, let's say i'm perfectly happy, knock on wood. and next july in the middle of the night for some reason i end up at the emergency room in some hospital on some vacation and they call in my insurance and they say i don't exist. >> that would be an interesting legal quandary. >> legal quandary, that's the least of it. >> the insurance company will say the problem is the information we got from the federal government off the website. but the consumer's going to say hey, i did this. >> think of how much fun it will be in the middle of the night spending all those hours on hold trying to sort it out when you have a sick child or something that's on your insurance policy. >> it's awful. people may or may not realize

they have this insurance. if you don't get a bill before the first of the year and you thought you enrolled and there's a problem there. people may not pay attention to that. if you don't get the insurance card in the mail, maybe you know that, maybe you don't. there may be some people who think they have health insurance and come january 1 will have to access that. could be july, november of next year that they make that first call to a doctor and find out there was this problem on the back end of the obama care website. >> is the obama administration confident that the young people, the young and healthy are really signing up and ginning this in order to support the older and more sick people? >> i think they're still concerned about that. >> what happens if we don't have the money? >> if we don't have the money in the next couple of years there's an ease off of subsidies that allow the insurance companies to still charge lower rates. >> so those people who think they got a good deal, their rates are going to go up. >> the rate also go up. the first real judge will be when the rates come out for 2015, 2016. then we'll know in the

federal obamacare web site is far f well, it's no secret, the federal obama care website is far from fixed. and now some states are trying to bypass the hub. the ceo of connecticut's exchange joins us. good evening, sir. >> good evening. >> why do you want to diskent from the federal website? you are a state exchange, right? a state-established exchange? >> that's correct. our goal is to service our customers as well as we can and as consistently as we can. we're really looking at our plans as a backup just in those instances when the federal data hub may have some problems or might be down. >> is your state exchange better than the federal exchanges? if so, how and why? >> you know, i don't know enough about the federal exchange really to comment on that. what i can tell you is that we've worked very hard in connecticut to try to provide a really good customer experience, to try to make something

complicated as simple and easy as possible. >> do you know how much sign up you've had? >> yes. we've had about 22,000 people, 60% of which are in private insured plans. we're expecting probably another 10,000 more with organic medicaid growth. >> how do you, what information do you need from the federal system? to what extent do you interact with the federal system so that could even be a problem for you if they had a problem? >> quewell, it surrounds identification and ability. we rely on things such as citizenship verification and eligibility for tax credits. and other types of programs. >> how about security? because there have been a lot of complaints at least by some of the good hackers who are testing the system is insecure and there are a lot of security issues that haven't been fixed. >> right, well, i don't know

much about the federal security and privacy issues. what i can tell you is that the connecticut system went through extensive testing for both privacy and security. we passed it well, and it's something we take very seriously. >> but if you're linked to the federal hub, don't newsom ways pick up some of the problems that they have in the federal hub with security or not? >> not that i'm aware of. my understand something that the tests that we passed make us like other states unique to our state. so i believe in fact that we've got that pretty well managed. >> if the federal is working well, if you think they're secure, why do you even want to diskent from them? >> it's to provide a back up. it's a contingency plan, where there may be maintenance, where there could be an error, where it could be going down. we're trying to be as self-rely and the as we can and make sure that our customers can keep enrolling in coverage when they

want. >> i think there are ten states that have done the exchanges. and yours is one of them. i'm curious, when you hear that the federal system may have enrollment problems, a third of the people who signed up may not actually be enrolled, what do you think about that? >> well, what i think mostly is how things are working for connecticut. we've done extensive testing of our system going back to the summer. we froze the code in september to make sure it could go into production well and errors could be fixed. we've worked collaboratively with our health plans in connecticut and we're confident that our enrollees are going to get their booklets and cards and are going to be enrolled in january 1. >> are they seeing sticker shock? >> affordable health insurance can be an oxymoron. 72% of our eligible individual policyholders are eligible for

and is president obama rewriting his own health care law? is he violating the constitution? now that is what the house judiciary committee is trying to figure out. >> indeed, president obama is the first president since richard nibsen to ignore a duly enacted law simply because he disagrees with it. we have seen a pattern. president obama circumvents congress when he doesn't get his way. >> the administration's decision to defer action against particular individuals is neither unusual nor unconstitutional. >> this method of law making has more in common with monarchy than with democracy and constitutional republic. >> prosecutorial discretion is

one thing. and georgetown's nicolas krants joins us. is he overstepping his constitutional powers? >> well, i think that he is. article ii of the constitution says that the president shall take care that the laws be faithfully executed. what the president has done in a number cases looks like rewriting the law than executing it. >> is he doing anything more than his predecessors? >> i think he is. president bush occasionally declined to execute statutes because he believed they were unconstitution unconstitutional. that's another matter. but president obama is declining to execute laws without a claim of constitutionality just for policy preference. >> let me go to obama care. specifically, has he done anything in that law that's overstepping the constitution in your opinion? >> yeah, i think that he has. he suspended the employer mandate for a year.

this is a provision of the statute which is crystal clear about the date when it starts, january 1. and he's decided to suspend it for an extra year and it's not because he thinks the statute's unconstitutional. it's because he finds it politically convenient to extend it for a year. this is in the teeth of the plain, clear text of the statute. >> if his job is to execute the law, congress is to legislate and create the law. his is to execute it and the judiciary is the one, the judges and everything. is there any way to challenge. it's a rather complicated issue. is there anyone who can go to court and say the president's going too far, is violating the statute in order to put a check on someone overstepping? >> you raise a question of standing. congress itself probably cannot challenge such inaction in court, but an individual possibly could. so an individual who should have received coverage under the employer mandate this year but won't because of the suspension,

i think, probably could go to court. >> but when we talk about standing, you talk about harm. i can't sue for a car accident i have nothing to do with because i haven't been harmed. but if you're in congress and your voters, your electors have given you the power to legislate and someone is stepping on your power to legislate, are you not harmed? i mean, the courts have just not permitted you to challenge the executive authority of the president? >> this is quite a naughty issue. the court's been hostile. >> is this district court? >> there's a good chance that an individual could challenge these actions. >> what's, what, let me take the extreme route. if you had someone way out of line, impeachment, is that the

only check? >> that's the ultimate remedy. there could be cases as we've discussed. there is the possibility that congress could retaliate in other ways. for example not confirm nominees, not advance his legislative agenda. >> but that doesn't define the limits of the constitutional authority. that's just a weapon to hit someone with. >> you're quite right. this is the ultimate backstop for a rogue proez is impeachment and election. >> if some citizen can some find reason to show he or she is harmed. >> i think that's probably true. >> and no one has done it with this. >> there have been a number of cases concerning obama care. >> on constitutional authority? >> the deferral of the employer mandate hasn't, isn't quite ripe yet, because it wasn't supposed to start until january 1. so this coming year somebody could perhaps bring a suit. >> professor, nice to talk you. >> great to talk to you.

okay. let's go off-the-record for okay. let's go off the record for just a minute. if this is true, what the house committee says, and if secretary sebelius has no good explanation, she needs to go. now here's what i'm talking about. yesterday the house sub committee on health asked secretary sebelius to testify. in that press release, it is reported that the committee just got documents that demonstrate that on april 4, secretary sebelius was warned about the challenges meeting the october 1 date. and despite that, secretary sebelius testified that implementation of the website was on track. on track, really? she got a warning 14 days earlier. but if that press release is complete and accurate, and if secretary sebelius has no good explanation or even if it's half

true and she was being cagey and slippery with the facts in her testimony, she must go. health care is not a hide-and-seek game where we are their pawns. if i were on that house committee she would be on notice tonight that i'd be grilling her on this. and i'd give her a fair chance to explain it. but if i thought she was be being deceitful or even a bit came e cagey, i'd tell her, that's it. go. and that's my off the record comment tonight. if you think there is an issue i should take off the record, go to greta wire.com and tell us about it. president obama, why didn't he wipe the slate clean, fire a couple people, that he won't accept incompetence when it comes to your health? welcome joe trippi. what do you think? should he have fired anybody?

credibility, brick by brick by himself at first. there are a lot of democrats who have just as frustrated as republicans about the implementation of the website and some of the other problems with obama care, but if he, do as the site starts to work better, if you see those bricks of credibility go back in place, i'm talking about tiny ones. i'm not talking about one big bolt that goes out, then i think you're going to see other democrats get on board and start to make the case. because frankly, they've got to. at this point, either -- democrats own obama care. it's got his name on it. we've got to make it work. democrats in congress got to help make it work and support it. and the republicans, it's worn out. they've been opposed to it from the get go. they've made it clear. and they're going to keep trying to throw up further impediments. >> i fully expect that the website will get up and running.

the one thing that sticks with me are the four security experts that said it wasn't fixed, couldn't be fixed. we had one last night as it relates to security. i assume that these people are being candid and honest, these experts on security. so what about that? >> if there is a security breach in which millions of people lose their personal information -- the whole thing is both sides are not telling the whole truth. if the republicans say we're all going to die, it's a disaster, the socialists have taken other and everybody's going to pay more for their health care or lose it or get cancellation notices. the democrats saying it's going to be great. we already know that that part of you can keep your health care plan and your doctor, period, wasn't the whole truth. the other side has to play out too. >> you have to peel aside the

billy kid's bicycles, does that have anything to do with the health care website? good evening, i should add that how they're spending their time, it's not on taxpayer dime, but tell me about this 2009 event that they had. >> this event, greta, was an off-site meeting, primarily of the top brass of cgi federal, which is the main contractor responsible for healthcare.gov. it included, it be being the off-site event, some team building exercises. these exercises are rife in corporate america. in this particular case, the exercise involved people putting together children's bicycles with tassels. and things apparently got out of hand a little. and people ended up riding the bicycles drunk throughout

hallways of this luxury resort. >> let me emphasize, it's a private company. it wasn't on the taxpayer dime, this one. i want to reemphasize that. what is cgi? who are they? >> cgi is interesting. cgi federal is based in fairfax, virginia. they are a very major sub contractor and contractor of the u.s. government. they basically are a technology company that does the plumbing on all kinds of wonky complex owned in turn by cgi group, which is based in montreal, so it is a canadian company. they're a huge technology company. they're probably the biggest and right now most important company you've never heard of. >> how are they doing financially? i saw one part of your story suggested they're getting shorted a lot which is never a good sign when your stock is being shorted. >> typically, when your stock is

being shorted people are betting that your stock price is overvalued and the shares are going to fall. but things can turn sour on that if there's a short squeeze. but most people would say that's generally not good news. >> are they getting contracts right now? are they a thriving company? >> they have a lot of legacy contracts that they're working through. they have bids going through on new contracts. they have had, according to financial analysts, a slow down in some booking, but all of these contracts are long tailed. so you have the problems and glitches right now with healthcare.gov. but you have a lot of ongoing projects and contracts with other u.s. government and foreign agencies. >> all right. now cgi federal, before it was cgi federal, who started the company? >> the entire company started in 1976 in quebec city by a frenchman. he built this into a
